TERMS OF SERVICE 

 

The online courses offered by Empowering Equine Education, including Equine Emergency Training, Horse Health Assessment, and Colic Bundle, are operated by Elizabeth McCready trading as Empowering Equine Education [ABN: 69207820992]. Throughout this document, the terms "we," "us," and "our" refer to Empowering Equine Education. Empowering Equine Education provides access to the courses, including all associated course materials, subject to your acceptance of these terms, conditions, policies, and notices.

By purchasing any course, you agree to be legally bound by these Terms of Service.


SECTION 1 - GENERAL CONDITIONS

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the course materials without express written permission from us.

The courses are provided for general informational and educational purposes only and should not be relied upon as the sole basis for decision-making without consulting a qualified veterinary professional. Any reliance on the course materials is at your own risk.


SECTION 2 - PAYMENT AND REFUND POLICY
  1. By purchasing access to a course, you agree to pay us the full amount as outlined on the applicable sales page/checkout page.

  2. We offer a Full Money-Back Guarantee for 14 days after the commencement of the course. If, for any reason, you are not satisfied, you may request a refund within this period by submitting a formal request in writing to [email protected]. Upon approval, your access to the course materials will be immediately discontinued.

  3. We reserve the right to investigate refund requests suspected of being related to piracy, unauthorized use, or abuse of the refund policy. If we determine that a refund request is made in bad faith or violates these Terms of Service, we may deny the request.

  4. Beyond the 14-day guarantee period, all sales are considered final, and refunds will not be provided unless required under Australian Consumer Law. Nothing in this Refund Policy overrides your rights under the Australian Consumer Law (ACL). If your refund request relates to your consumer rights under ACL, please contact[email protected], and we will assess your claim in line with Australian law.

  5. If you select a payment plan option, you agree to complete all scheduled payments as outlined at checkout. If you choose to discontinue your participation in a course, full payment is still required.

  6. Failure to make a scheduled payment may result in immediate suspension of access to the course materials, including all modules, materials, and live calls. If payment remains outstanding for 14 days, we may terminate your access and take legal action to recover the outstanding balance. You will be responsible for any legal costs incurred in pursuing missing payments.

  7. By purchasing under a payment plan, you authorize us to charge your selected payment method for the agreed amounts and on the agreed schedule.


SECTION 3 - ACCURACY OF BILLING INFORMATION

You agree to provide and maintain accurate billing details, including email address, credit card number, and expiration date, to ensure successful transactions.


SECTION 4 – LIMITATION OF LIABILITY

The courses are provided "as is" and intended for general consumer education. Your access to the courses is voluntary and at your sole risk. We do not warrant that the results obtained from using the courses will be reliable or error-free.

In no event shall we be liable for any injury, loss, claim, or damages, including but not limited to:

  • Faulty design or misleading advice,
  • Loss arising from use of the courses,
  • Indirect, special, or consequential damages, or
  • Injury to yourself, your equine, or any person, corporation, or other entity.

The course materials do not replace professional veterinary advice, diagnosis, or treatment. Always consult a qualified veterinarian regarding your horse’s health.

By agreeing to these Terms of Service, you acknowledge the inherent risks of horse ownership and handling and assume all responsibility for your participation in the courses.


SECTION 5 – AUSTRALIAN CONSUMER LAW COMPLIANCE

Subject to the succeeding clause, and to the extent permitted by the Australian Consumer Law and the Goods Act 1958, our sole obligation under this agreement is to use our best efforts to provide the course or, at our discretion, to repair or replace any part of the course found to be defective within a period of six weeks.

If any course materials supplied pursuant to this agreement are supplied to the customer as a 'consumer' of goods or services within the meaning of that term in the Australian Consumer Law (as amended) or the Goods Act 1958, the consumer will have the benefit of certain non-excludable rights and remedies in respect of the course or associated services. Nothing in these terms and conditions excludes, restricts or modifies any condition, warranty, right or remedy which pursuant to the Competition and Consumer Act 2010 or the Goods Act 1958 is so conferred.

However, if the course is not a product ordinarily acquired for personal, domestic or household use or consumption, pursuant to section 64A of the Australian Consumer Law and similar provisions of the Goods Act 1958, we limit our liability to payment of an amount equal to the lowest of: 

  • The cost of replacing the course materials or providing an equivalent; 
  • The cost of repair of the course materials; or
  • The cost of having the course materials repaired or replaced. 

We are not liable for any failure or delay due to events beyond our control, including acts of acts of God, civil or military authority, war, accidents, fires, explosions, earthquakes, floods, extreme weather, strikes, labour disputes, or shortages of essential materials, labour, or transportation.

Subject to the above, we are not responsible for any loss caused by errors or defects in the course or third-party suppliers.


SECTION 6 - ACCURACY AND COMPLETENESS OF INFORMATION

While the course materials are created by a qualified professional and verified for accuracy, we make no guarantees that all information is complete or up to date.


SECTION 7 - MODIFICATIONS TO THE COURSES AND PRICES

Prices for the courses may change without notice.

We reserve the right to modify, suspend, or discontinue any course at any time without liability to you.


SECTION 8 - PROHIBITED USES

You may not use the course materials for:

  • Unlawful purposes,
  • Violating regulations or intellectual property rights,
  • Harassment, abuse, discrimination,
  • Submitting false information,
  • Collecting personal data of others.

Violation of these terms may result in termination of access.


SECTION 9 - INDEMNIFICATION

You agree to indemnify Empowering Equine Education against any claims arising from your breach of these Terms of Service or your misuse of the course materials.


SECTION 10 - SEVERABILITY

If any provision in these Terms of Service is deemed unenforceable, the remaining provisions remain in effect.


SECTION 11 - TERMINATION

These Terms of Service remain in effect unless terminated by either party. You have 14 days from the date of purchase to request removal from a course. We may terminate this agreement if you breach any of these Terms of Service.


SECTION 12 - GOVERNING LAW

The Terms of Service of any sale shall be governed by the Sale of Goods Act 1958 and construed in accordance with the laws of the State of Victoria, Australia and the parties submit to the jurisdiction of the Victorian courts.


SECTION 13 - CHANGES TO TERMS OF SERVICE

We reserve the right to update or modify these Terms of Service by providing written notice. Continued use of the courses constitutes acceptance of any changes.


SECTION 14 - DISCLAIMER

By agreeing to these Terms of Service, you confirm that you are either:

  • At least the age of majority in your state/country, or
  • The legal guardian of a minor using the courses with your consent.
