The “Equine Emergency Training” (“EET”) is operated by Elizabeth McCready trading as Empowering Equine Education [ABN: 69207820992]. Throughout the text, the terms “we”, “us” and “our” refer to Empowering Equine Education. Empowering Equine Education offers the “Equine Emergency Training” conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By purchasing the “Equine Emergency Training” from us, you engage in our “Service” and agree to be legally bound by the following terms and conditions.

 

SECTION 1 - GENERAL CONDITIONS

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the “Equine Emergency Training”, without express written permission by us.

The Service provided for general information and education purposes only and should not be relied upon or used as the sole basis for making decisions without consulting a veterinary professional. Any reliance on the material in “Equine Emergency Training” is at your own risk.

 

SECTION 2 - PAYMENT AND REFUND POLICY

  1. By purchasing the Service you agree to pay us the full purchase amount as outlined on the “Equine Emergency Training” sales page/checkout page. 
  2. Without limiting your rights at law, including, for Australian customers, the Australian Consumer Law, refunds requested within 24 hours of purchase are subject to investigation to prevent piracy. 
  3. A Full Money Back Guarantee is available for 14 days after commencement of the Service. To request a refund during this time period a formal request must be made in writing to [email protected]. Following the request of a refund your access to the Service will be immediately discontinued. 
  4. Due to the nature of this Service, refunds beyond 14 days after commencement of the Service are only considered in exceptional circumstances. A formal request must be made in writing to [email protected]. Refunds after 14 days from commencement are prohibited for instances where the customer simply changes their mind about the Service. All sales are otherwise considered final.
  5. If you select a payment plan option, you agree to pay all fees to us according to the payment schedule set forth on the sales page/checkout page. Should you decide not to continue with the Service at any time, full payment will still be due.
  6. In the event you fail to make any of the payments within a payment plan during the time prescribed, we have the right to immediately disallow participation by you until payment is paid in full, including disallowing access to modules, materials, and live calls. If the fee has not been paid within fourteen (14) days, we have the right to terminate this agreement and may pursue legal action. You will be liable to cover the legal costs incurred by us to pursue any missing payment.
  7. Credit Card Authorization (if applicable for payment plan). Each Party hereto acknowledges that we will charge the credit card chosen by you, the Client.

 

SECTION 3 - ACCURACY OF BILLING INFORMATION

You agree to provide current, complete and accurate billing information. You agree to promptly update your billing information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

 

SECTION 4 – LIMITATION OF LIABILITY

The information provided in the “Equine Emergency Training: is provided on an “as is” basis and is intended for general consumer understanding and education only. Access to the Service is voluntary and at the sole risk of the user. We do not warrant that the results that may be obtained from the use of the Service will be reliable or error-free.

In no case shall Empowering Equine Education be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, arising from your use of The Service or any content made available, including but not limited to injury, loss or damage involving yourself, an equine or additional third-party. Nothing contained in the “Equine Emergency Training” is or should be used as a substitute for situational and tailored veterinary professional medical advice, diagnosis and treatment. Always seek the immediate guidance of your veterinary professional with any questions you have regarding your equine’s health or personal safety.

By agreeing to these Terms of Service you acknowledge that owning and handling equines can be dangerous and unpredictable, involving a risk of serious injury or death, and you choose to take part in the “Equine Emergency Training” at your own risk.

Due to some states and jurisdictions not allowing the exclusion or limitation of liability for consequential or incidental damages, in such instances our liability shall be limited to the maximum extent permitted by law. In all other circumstances, Empowering Equine Education’s [ABN: 69207820992] total liability shall be limited to the amount you have paid for The Service.

 

SECTION 5 – ACCURACY AND COMPLETENESS OF INFORMATION

While the materials provided in the “Equine Emergency Training” have been prepared by an appropriately qualified professional and all attempts have been made by us to verify the accuracy of the information provided, we make no warranties that the information is complete.

 

SECTION 6 - MODIFICATIONS TO THE SERVICE AND PRICES

Prices for the “Equine Emergency Training” are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

 

SECTION 7 - PROHIBITED USES

You agree to indemnify, defend and hold harmless Empowering Equine Education and our service providers, from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

 

 SECTION 9 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

 

SECTION 10 - TERMINATION

These Terms of Service are effective unless and until terminated by either you or us. You have 7 days from the first day of participating in the Service to request removal from the “Equine Emergency Training''. Any request after 11:59 PM Australian Eastern Standard Time on the 7th day from commencement of the Service is NOT ELIGIBLE for voluntary removal.

If you selected the payment plan option and you do not request a removal by the end of the 7th day, you are required to complete the remaining payments of your payment plan. In order to request removal, you must submit your request in writing to [email protected] by the 7th day from the start participation in the Service. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.  

If in our sole judgement you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

 

SECTION 11 - ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us within The Service or in respect to The Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the state of Victoria, Australia.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by notifying you via email and providing an updated Terms of Service documentation. By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this service.
